Terms of Service

The use of services offered by VisFind Media Pty Ltd is subject to agreement of the following terms and conditions.

Acceptable Use Policy

It is a condition of using the VisFind web site that you do not:

defame, abuse, stalk, harass, threaten or otherwise violate the legal rights of others, including rights relating to privacy
transmit any message, data, image or program, which is indecent, obscene or pornographic
transmit any message, data, image or program that would violate the property rights of others, including unauthorized copyrighted text, images or programs, trade secrets or other confidential proprietary information
interfere with the rights of others to use the service
transmit any file which contains viruses, worms, "Trojan horses" or any other contaminating or destructive features
use the facilities and capabilities of the service to conduct any activity or solicit the performance of any illegal activity
impersonate or falsely represent your association with any person or organization
use, reproduce, sell, resell or otherwise exploit any of the services for commercial purposes
attempt to modify, adapt, translate, sell, reverse engineer, decompile or disassemble any portion of the site, including the use of automated tools
access or attempt to access information resources you are not authorized to use

Member Conduct

Any abuse of the Terms of Service may, at the discretion of VisFind Media Pty Ltd, result in restrictions or suspension of access to certain member services, or outright termination of your membership.

Display Names

All VisFind users should be aware that display names do not constitute an accurate form of identification. Display names can be modified at any time and are not required to be unique. If you require a reliable form of identification, use the membership ID number.

Members are expected to choose display names that are in good taste, with no offensive language.

Advertisement Content

Advertisement text is expected to be appropriate for a general audience. Deliberate and inappropriate use of offensive language is not permitted.

Advertisement images are expected to be appropriate for a general audience, even if the associated web site is not. Images of an overtly sexual or violent nature are not permitted. Images intended to incite violence or hate or deliberately offend minority or religious groups are also not permitted.

VisFind Media Pty Ltd reserves the right to refuse to host an advertisement, even if it complies fully with the Terms of Service agreement.

Banned Content

The following content is banned from being advertised on VisFind:

child pornography, or sexually explicit content relating to people under the age of 18 years;
sale or promotion of human slaves, organs for transplant, illicit drugs, or tobacco products;
promoting terrorism or inciting of hatred or violence against others;
"phishing" and other fraudulent activities;
"warez" sites, or sites providing illegal access to pirated software, movies, music, or other intellectual properties;
or any other illegal content.

Any attempts to advertise such content will be immediately referred to the appropriate law enforcement authorities. If such content manages to sneak through undetected, we may choose to take legal action against the advertiser.

Editing Advertisements

Advertisers are permitted to make changes to their advertisements at any time without notice to VisFind Media Pty Ltd. However, all changes must comply with the Terms of Service. All changes are fully logged, and action will be taken against members who have been found to abuse this privilege.

Advertisements are expected to accurately reflect the content they advertise at all times. Advertisements that deliberately mislead users to offensive or inappropriate content will not be tolerated.

Reorganization of Directory

VisFind Media Pty Ltd may reorganize the visual web directory at any time without notice. These reorganizations may involve changes to the categories in which advertisements are placed.

Advertisers may request recategorization of an advertisement. A request for recategorization may take several weeks to process, depending on the nature of the request. VisFind Media Pty Ltd reserves the right to reject requests for recategorization.

Cancellations and Refunds

Members may terminate their own subscriptions at any time either through the VisFind web site or directly from the PayPal web site.

All subscription payments are made at the beginning of a billing period. When you voluntarily terminate a subscription, the associated advertisement will remain in the directory for the remainder of the billing period for which you have paid.

VisFind Media Pty Ltd reserves the right to suspend or terminate subscriptions or member accounts at any time with or without notice. Subscriptions may be automatically terminated if a payment fails due to insufficient funds or other restrictions imposed either by PayPal or your credit card service.

If VisFind Media Pty Ltd chooses to terminate your advertisement immediately (your PayPal subscription is cancelled and the advertisement immediately removed from the directory), the amount already paid for the remainder of the current billing period will be refunded.

All other forms of refund will be at the discretion of VisFind Media Pty Ltd.

Price Changes

VisFind Media Pty Ltd reserves the right to alter prices at any time.

Alterations to pricing will only affect new subscriptions. Existing subscriptions will remain at the same monthly rate until the termination of that subscription.

VisFind AdBox Network

The AdBox Network is a bonus service provided to advertisers free of charge. Selection of advertisements is based on a random algorithm that favors least-recently shown advertisements. Changes to this algorithm (such as optimizations) may be made without notice. VisFind Media Pty Ltd makes no guarantees on the frequency with which advertisements will be shown on AdBoxes.

Advertisers should be aware that the AdBox Network may experience disruptions from time to time, either as a result of necessary maintenance, or network problems outside the control of VisFind Media Pty Ltd.

Backups and Data Loss

VisFind Media Pty Ltd makes comprehensive backups of all data on a daily basis. However, advertisers are advised to keep copies of all images, emails and other documents relating to their advertisements. Advertisers should not assume that such data will be recoverable after a catastrophic failure.

Disclosure to Law Enforcement

VisFind Media Pty Ltd may disclose information about member accounts and logged activities to law enforcement agencies without further consent or notification to the member upon lawful request from such agencies.

We intend to cooperate fully with law enforcement agencies.

Changes to Policies

VisFind Media Pty Ltd reserves the right to revise its policies at any time without notice.
